An appellate bench of High Court of Sindh (SHC) comprising Justice Sarmad Jalal Osmany and Justice Azizullah M Memon admitted two accused of kidnapping to bail terming a six years' delay in conclusion of their trial as "shocking." Mir Muhammad and Amanullah were arrested in December 1997 by Karachi police on the charge of kidnapping Naseer Ahmed Jagrani, a General Manager in PSO on 22 November, 1997.

They were charged with the offence along with co-accused Muhammad and Roshan Khan and the charge sheet showed that they also demanded ransom for release of the victim.

When their plea came up for hearing on Wednesday, counsel prayed for bail on the ground that since previous eight years or so they were languishing in the jail waiting for the conclusion of trial, there was no previous record of their criminal activity, and thus could not be dubbed as hardened or desperate.

Assistant Advocate General Sindh appearing for the state expressed astonishment and said that was a case of shocking delay.

The bench after perusing the case file admitted applicants/accused to bail against two solvent sureties of Rs 200,000 each. The bench also ordered production of co-accused Muhammad and Roshan Khan before the bench on 22 February 2005.

The Bench also put counsel for accused/applicant on notice that why charge was framed under section 365 (Kidnapping) try able and being tried by Special Court for Suppression of Terrorist Activities (STA) and not under section 365-A (kidnapping for ransom) try able before an Anti Terrorism Court (ATC) as accused demanded ransom for release of the victim.
